According to Circular Letter No. 3,624/13 from the Brazilian Central Bank, the deadline for submitting the annual declaration of the Brazilian Capital Abroad, on the reference date of December 31^st, 2014, expires at 10am on April 6th. Who must declare?

Individuals and legal entities, including investment funds, resident, domiciled or headquartered in Brazil who held abroad, until December 31^st, 2014, property and assets totaling the amount equal to or greater than US$ 100,000.00 (one hundred thousand United States of America Dollars), or its equivalent in other currencies.

Who is exempt from the declaration?

Those who had property and assets in amounts smaller than US$ 100,000.00 (one hundred thousand United States of America Dollars), on the reference date referred, are exempted from submitting the declaration.

Quarterly Declaration

Beside the annual declaration, individuals and legal entities, including investment funds, resident, domiciled or headquartered in Brazil who held abroad, until the reference date of each quarter, property and assets totaling the amount equal to or greater than US$ 100.000.000,00 (one hundred million United States of America Dollars), or its equivalent in other currencies. Those who had property and assets in amounts inferior to the above mentioned, on the reference dates referred hereunder, are exempted from submitting the declaration.

1. Reference date of March 31^st, 2015: from April 30^th until June 5^th at 6 p.m.;
2. Reference date of June 30^th, 2015: from July 31^st until September 8^th at 10 a.m.;
3. Reference date of September 30^th, 2015: from October 31^st until December 7^th at 10 a.m.

Observations and Penalties

Those responsible for the declaration must retain, for five years as of December 31^st, 2014, the documentation evidencing the information provided in order to be submitted to the Central Bank of Brazil, whenever requested.

Failure to declare, within the referred period, or providing false, incomplete or incorrect declarations subjects the responsible for the declaration to penalties that vary according to the infraction and can reach the maximum amount of R$250,000.00 according to article 58 of Law No. 4.131/62, updated by Provisional Act No. 2.224/01, and Resolution No. 4.104/12.
