Go backToday (October 17th, 2014) Decree n. 8.327, which enacts in Brazil the 1980 Vienna Convention on the International Sale of Goods (CISG), was published. CISG applies to contracts of sale of goods entered into by parties whose places of business are in different countries. The Convention has the status of statutory law in Brazilian legal system and it does not revoke previous statutory laws on the subject of purchase and sale of goods, which remain fully applicable to the sale of goods between nationals. Therefore, when choosing Brazilian law in an international purchase and sale of goods contract, parties will be deciding necessarily to apply CISG, unless they expressly waive its application. It is important to highlight that CISG has its own and unique system, which is different from the one concerning domestic purchase and sale contracts, so that the issue has to be taken into account in international negotiations from now on.
