Yesterday, April 29, 2020, the Provisional Measure No. 959/2020 was published, which, among other issues, determined that the General Data Protection Law – GDPL (Law No. 13.709/18) would enter into effect on May 03, 2021, rather than its original projection for August 2020.

The Bill of Law No. 1.179/2929, currently awaiting approval, intends to establish a new emergency legal framework concerning private relationships during the period of the coronavirus pandemic, including a distinction in two stages for the implementation of the GDPL: its term of validity and a specific term for the application of sanctions. This aspect, however, was not adopted by the Provisional Measure. Therefore, all the provisions of General Data Protection Law (with an exception for the articles dealing with the creation of the National Data Protection Authority) will enter into effect on the same date.

The Provisional Measure is valid for 60 days and can be renewed for the same period of time. After the referred term, it must be submitted for approval and converted into an ordinary law, otherwise it will become invalid.
